Please read these Terms and Conditions carefully before using Datea. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use Datea.
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and Datea ("Datea," "we," "us," "our") governing your access to and use of the Datea mobile application and any related services (collectively, the "Platform").
By registering an account, you affirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Eligibility
- You must be at least 18 years of age to use Datea. By registering, you represent and warrant that you are 18 or older.
- You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
- You must not be prohibited from using dating or social networking services under applicable law.
- You must not be a registered sex offender or have been convicted of a violent crime.
We reserve the right to verify your age or identity at any time and to suspend or permanently terminate accounts that do not meet these requirements.
3. Account Registration and Security
Datea uses phone number verification only for account creation and sign-in. We do not support email/password, Google, or Apple sign-in methods. A one-time passcode (OTP) is sent to your phone number to verify your identity.
- You agree to provide accurate, current, and complete information when creating your account, including your real phone number.
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
- You must notify us immediately at support@getdatea.app if you suspect unauthorized access to your account.
- You may only maintain one account. Creating duplicate or fake accounts is prohibited.
- Biometric unlock (Face ID / fingerprint) is an optional security feature you may enable in Settings. Biometric data is processed entirely on-device by your operating system; Datea does not collect or store any biometric data.
4. User Conduct
You agree not to use Datea to:
- Harass, bully, intimidate, stalk, threaten, or harm any other user.
- Post content that is abusive, defamatory, obscene, pornographic, or sexually explicit.
- Impersonate another person or misrepresent your identity, age, gender, or affiliation.
- Solicit money, financial information, or other personal information from other users.
- Engage in any form of commercial solicitation, spam, or advertising.
- Post content promoting illegal activities, violence, hate speech, or discrimination based on race, ethnicity, religion, gender identity, gender expression, sexual orientation, or disability.
- Share another person's private information without their consent ("doxxing").
- Use automated bots, scripts, or tools to interact with the Platform.
- Attempt to circumvent, reverse-engineer, or otherwise tamper with the Platform's security measures.
- Violate any applicable local, national, or international law or regulation.
5. Content You Post
You retain ownership of content you create and share on Datea. By posting content, you grant Datea a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating and improving the Platform.
You represent and warrant that:
- You own or have the right to share any content you post.
- Your content does not infringe any third party's intellectual property, privacy, or other rights.
- Your photos genuinely represent you and are not stolen from another person.
- Profile information you provide — including your name, age, and gender — is accurate. Datea supports the following gender identities: Man, Woman, Transman, Transwoman, Non-binary, and Other. You may accurately select the option that represents you.
We reserve the right to remove any content that violates these Terms, without notice or liability.
6. Stories
Stories are short-lived posts visible to other Datea users for up to 24 hours, after which they are automatically and permanently deleted. Datea limits each user to one active story at a time as a deliberate design choice to encourage focused, authentic sharing. We make no guarantees that a story will be available for the full 24-hour period in the event of technical issues.
7. Connections and Messaging
Datea enables users to form exclusive 1-on-1 connections through a pitch-and-accept model. Once connected, users can communicate via in-app messaging. You agree that all communication through the Platform must comply with these Terms and must not be used to harass, threaten, or solicit other users.
8. In-Person Meetings — Assumption of Risk
Important: Datea is an online platform. When you choose to meet another user in person, you do so entirely at your own risk. Datea has no control over, and expressly disclaims all liability for, any interactions, events, injuries, losses, or damages that occur outside of the Platform.
You acknowledge and agree that:
- Datea does not conduct criminal background checks on users. Verification features confirm a user's phone number or identity document but do not guarantee that a user is safe to meet.
- Datea cannot verify the truth of any information users provide about themselves, including their intentions, character, or history.
- You are solely responsible for exercising caution and conducting your own due diligence before agreeing to meet another user in person.
- Any physical interaction between users — including but not limited to dates, meetups, and any resulting physical, emotional, or financial harm — is entirely outside Datea's scope of service and responsibility.
- Datea shall not be liable for any injury, assault, harassment, property damage, financial loss, or any other harm arising from in-person meetings arranged through the Platform.
- You release and hold harmless Datea, its officers, employees, and agents from any claims arising from your in-person interactions with other users.
Our Safety Recommendations
We genuinely care about your wellbeing. Before meeting someone from Datea in person, we strongly encourage you to:
- Video chat or speak by phone before your first in-person meeting to verify the person is who they claim to be.
- Meet for the first time in a busy, public location (a café, restaurant, or shopping center).
- Tell a trusted friend or family member where you are going, who you are meeting, and when you expect to return.
- Arrange your own transportation — do not accept rides from someone you just met.
- Trust your instincts. If something feels wrong, leave immediately. Your safety is more important than politeness.
- Do not share your home address, workplace, or daily routine with someone you have not built trust with over time.
- Never send money to a connection, regardless of how compelling their story seems.
- If you feel you are in immediate danger, contact local emergency services (911 or your local equivalent) immediately.
9. Reporting and Blocking
Datea provides in-app tools to report and block users who violate these Terms or make you feel unsafe. We encourage you to use these tools. We take all reports seriously and will investigate reported violations. However, we cannot guarantee a specific outcome or timeline for every report. For urgent safety concerns, please contact local law enforcement.

10. Paid Subscriptions
Datea offers two optional paid subscription tiers — Datea Brew and Datea Reserve — that unlock additional features beyond the free tier. Subscriptions are billed through the Apple App Store or Google Play Store depending on your device.
Datea Brew
Datea Brew unlocks unlimited posts, unlimited daily pitches, voice pitches, photo reveals, post boosts, the online status indicator, access to previous conversations, and a Brew badge on your profile.
Available billing periods: Monthly ($9.99/mo) or Yearly ($59.99/yr). Prices may vary by region as set by the App Store or Play Store.
Datea Reserve
Datea Reserve includes everything in Datea Brew plus access to video and audio calls (when available). Reserve is available for purchase at a higher price point: Monthly ($14.99/mo) or Yearly ($89.99/yr). Prices may vary by region.
General Subscription Terms
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Manage or cancel your subscription through your device's App Store or Play Store settings.
- Refunds are governed by Apple's and Google's respective refund policies. Datea does not process refunds directly.
- We reserve the right to modify, add, or remove subscription features at any time. We will provide reasonable notice of material changes.
- Features listed as "coming soon" are not yet available and are not included in the current price of any subscription tier until they are released.
11. Intellectual Property
The Datea name, logo, design, and all Platform content created by us (excluding user-generated content) are the intellectual property of Datea and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from our intellectual property without our express written consent.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Platform will be uninterrupted, error-free, or free of viruses.
- Any user profiles are authentic or that users are who they claim to be.
- Using Datea will result in any particular outcome, including finding a partner or connection.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DATEA AND ITS OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, revenue, or profits;
- Personal injury or property damage arising from your use of the Platform or from in-person meetings with other users;
- Unauthorized access to or use of your account or personal information;
- Conduct of any third party on the Platform.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the greater of (a) the amount you paid to Datea in the twelve months preceding the claim or (b) USD $100.
14. Indemnification
You agree to indemnify, defend, and hold harmless Datea and its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your content; or (d) your interaction with any other user, whether online or in person.
15. Termination
We reserve the right to suspend or permanently terminate your account, at our sole discretion, without notice or liability, for any violation of these Terms or for any conduct we deem harmful to users or to the Platform. You may delete your account at any time through the app settings. Upon termination, your license to use the Platform ceases immediately.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Datea shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in the Philippines.
International users: Datea is a global app. The choice of Philippine governing law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. In particular:
- If you are located in the European Economic Area or United Kingdom, you retain all rights afforded to you under GDPR and applicable EU/UK consumer protection law.
- If you are located in Australia, you retain rights under the Australian Consumer Law that cannot be excluded.
- If you are located in California, USA, you retain rights under the California Consumer Privacy Act (CCPA).
- Users in any jurisdiction retain rights under mandatory local consumer protection laws that cannot be waived by contract.
Nothing in these Terms is intended to, or shall, limit any rights you have under the mandatory laws of your country.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect. Your continued use of Datea after the effective date constitutes your acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Datea regarding your use of the Platform and supersede all prior agreements, understandings, or negotiations.
